BEALS, J. -- December 5, 1936, Anna L. Johnson (formerly Anna L. Slack) recovered judgment upon these promissory notes, in the superior court for Chelan county, against H. B. Courtney and Marjorie D. Courtney, his wife, and Claude E. Stewart and Christa A. Stewart, his wife, for the sum of $915, together with attorneys fees and costs. The defendants were joint and several makers of the promissory notes, which were merged in the judgment, which was entered against them jointly and severally, and against the respective marital communities. March 11, 1937, there was signed and delivered an instrument in writing, entitled in the action, in words and figures as follows:
